Effective Date: July 11, 2025

Welcome to GetAway Bay (the “Property”), a privately owned park, beach, and waterpark owned and operated by Arete Entertainment LLC and located at 16339 Cone Rd., Milan, MI 48160. By entering or using any part of this Property, you (“Guest”) acknowledge that you have read, understood, and agree to be bound by the following Terms of Service. If you do not agree to these terms, you must immediately leave the premises.

1. Acceptance of Terms

You accept and will comply with all rules and these Terms of Service.
You enter and use the Property and its facilities at your own risk.
You assume all responsibility for your own safety and the safety of your minor children and any dependents under your care.

2. Assumption of Risk

The Property includes deep water areas, natural and manmade terrain, and recreational structures that may pose risks including drowning, injury, or death.
No lifeguards are on duty, unless expressly stated otherwise by posted signage or authorized personnel.
If you are not a strong swimmer, you must wear a lifejacket when entering any water area.
Personal flotation devices (PFDs) are strongly recommended for all guests, especially children.

3. Supervision of Minors

All minor children (under the age of 18) must be accompanied by a responsible adult at all times.
Parents and legal guardians are solely responsible for the safety and conduct of their children while on the Property.
The Property and its owners assume no responsibility for the supervision of minors.

4. No Refund Policy

All fees paid for entry, rentals, or activities are non-refundable, including but not limited to weather-related closures, behavioral removals, or early departure. No exceptions will be made.
For prepaid events, private bookings, and parties, any deposit is refundable only if canceled in writing at least thirty (30) days prior to the scheduled event date.
If canceled within 30 days of the event, any fees or deposits are non-refundable, but may be credited toward a future rescheduled date, subject to availability and management approval.
All rescheduled dates must be agreed upon in writing, and any exceptions to this policy must be made in writing and authorized by Property management.

5. Park Rules

By entering the Property, you agree to abide by all posted and published Park Rules. Failure to follow these rules may result in immediate ejection from the Property and/or a permanent ban from returning. Rules include, but are not limited to:
- No fighting or threatening behavior of any kind.
- Be respectful of other guests, families, and staff at all times.
- No swimming across the lake unless wearing an approved flotation device.
- No access to the waterpark obstacle course without wearing a wristband and lifejacket.
- Listen to all instructions from Property staff and security.
- No underage drinking. Alcohol consumption by minors is strictly prohibited.
- No glass bottles or containers are allowed on the Property.
- No pets are allowed on weekends.
- On weekdays, pets must be kept on a leash at all times, and:
- Owners must clean up after their pets.
- Pets are not allowed on the sand.
- Failure to supervise children or correct disruptive or unsafe behavior will result in removal from the Property.
The enforcement of these rules is at the sole discretion of Property management and staff. No refunds will be issued to individuals or parties removed from the Property for rule violations.

6. Limitation of Liability

To the fullest extent permitted by law, the owners, operators, affiliates, agents, and employees of the Property are not liable for any injury, loss, damage, or death arising out of your use of or presence on the Property, whether caused by negligence, natural conditions, other guests, or your own actions.

7. Indemnification

You agree to indemnify and hold harmless the Property and its owners, employees, and agents from any claims, demands, damages, or expenses (including attorney fees) arising out of your use of the Property, your violation of these Terms, or any conduct by minors or dependents under your supervision.

8. Modifications to Terms

The Property reserves the right to update or change these Terms at any time without notice. Continued presence or use of the Property after any changes constitutes your acceptance of the new terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles.

10. Severability

If any provision of these Terms is held to be invalid or unenforceable, all remaining provisions shall remain in full force and effect.

12. Shipping Policy

We do not ship any of our products. All items purchased or ordered must be used or consumed on the Property, unless otherwise explicitly stated in writing by GetAway Bay management.

BY ENTERING THE PROPERTY, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THESE TERMS OF SERVICE. YOU ASSUME FULL RESPONSIBILITY FOR YOUR SAFETY AND THE SAFETY OF ANY CHILDREN OR DEPENDENTS UNDER YOUR CARE.
